An LLC approval letter answers a state registration question. It does not tell you that an S election is right for your business. Before choosing a tax label, build a picture of who owns the company, how it earns money and how you plan to pay the people doing the work.
Start with your current classification and compare the ongoing work of each option. An election is not a universal shortcut to lower taxes.
Your LLC and its tax treatment are separate
Your entity is formed with the state. Tax classification is a separate decision.
A domestic LLC with one owner is generally disregarded for federal income tax; one with two or more owners generally defaults to partnership treatment. Eligible LLCs can elect corporate tax treatment, including S corporation treatment when its conditions are met. Employment and certain excise taxes have separate rules.
Draw two boxes on a page: “state entity” and “federal tax treatment.” Put your formation document in the first and your confirmed tax classification in the second. Keep this sheet with your records so a bank form or online questionnaire does not become a guessing exercise.
Compare a full year of work
Ask your tax professional to compare your current situation with an S election using the same realistic revenue and expense assumptions. Include return preparation, payroll, state obligations and the time needed to keep records. Ask what happens if sales fall; a strong month is not a full-year forecast.
Hypothetical example: a designer has a busy launch quarter but irregular projects afterward. Instead of electing based on one invoice, she prepares a conservative annual forecast and a slower-sales version. Both become inputs for advice, not proof of savings.
Bring a decision sheet
Write down the owners, their roles, expected profit before owner pay, any employees, and the states where you work. Ask which assumptions would change the recommendation. Save the comparison and the reason for the chosen effective date.
Useful questions include: What classification do we have now? Which returns and payroll tasks would change? Who handles each new obligation? When should we revisit the choice? Avoid treating a profit threshold from social media as a personalized answer.
